General conditions of sale

Acceptance of conditions

By placing an order, the client acknowledges having taken cognizance of the specific conditions of sale set out on this page, and explicitly declares acceptance of them without reserve. The present general conditions of sale govern the contractual relations between Japonika Kitchen and the client, and both parties accept them without reserve. These general conditions of sale take precedence over any other conditions appearing in any other document, unless previously specified otherwise in writing.

Products

The photographs illustrating the products are not binding. Japonika Kitchen shall not be held liable for any error or mistake in the photographs.

Ordering

Automated records are considered to be proof of the nature, content and date of the order. Japonika Kitchen sends the client confirmation of acceptance of the order to the address that the client has provided. The sale is not completed until the order it confirmed. Japonika Kitchen reserves the right to cancel any order from a client with whom there is a dispute concerning payment.
The client is responsible for the information provided to and order placed with Japonika Kitchen; if there is an error in the addressee’s contact information, Thés du Japon shall not be held liable for any delivery problems or the inability to deliver the product or products.

Delivery

After confirmation of an order, its validation on the website and payment, Japonika Kitchen shall take all reasonable action to deliver the order as rapidly as possible.
For deliveries outside Japan, the client undertakes to pay all duty and taxes applying to the import of products in accordance with the laws of the addressee’s country. Japonika Kitchen shall not be held liable if the client fails to pay the applicable taxes and duty.
Delivery shall be by mail or EMS, according to the client’s choice.

Prices

Prices are given in Euros or US dollars, depending on the currency selected.
The price on the product description does not include delivery costs.
The price on the order confirmation is definitive, but excludes the import taxes and duties applying in the addressee’s country.
The definitive price includes the product, handling and delivery.
Japonika Kitchen reserves the right to change its prices at any time. However, the client will be charged the price in effect at the time the order is placed.

Payment

The client shall be billed the price indicated on the order confirmation sent by Japonika Kitchen.
The price of the products is payable as of the day the order is confirmed.
Payment shall be made by credit card through a secure payment centre, without going through the boutique’s server.
An order validated by the client shall be considered confirmed only once the payment centre has approved the payment. If payment is rejected, the order will be cancelled automatically and the client will be notified of this by email. Japonika Kitchen reserves the right to reject any order from a client with whom there is a dispute.

Cancellation

Once an order is confirmed, Japonika Kitchen can under no circumstances accept that the order be cancelled.

Return policy

If, upon receipt of the order, the content is damaged, the client must obtain an acknowledgement of damage from the delivery service. Next, the client has to contact Japonika Kitchen within 3 days of receipt of the package (the delivery date is indicated on the Japan Post site, and can be found thanks to the package's tracking number), and send the damaged item or items back to us within 7 days. We will replace the item or items in question, and reimburse the client for the return shipping costs.

To return an item shipped internationally for any reason, the client must contactJaponika Kitchen within three days of receiving the package and send the item to the provided address within seven days of receiving the package.
• Japonika Kitchen will only refund up to the item price reduced by 10%.
• The customer shall pay for all shipping costs.
• Japonika Kitchen will issue a refund after receiving of the returned item, verifying the item is undamaged and verifying it is unused.
• Refunds will only be issued by PayPal.
• Japonika Kitchen will not refund dried edibles flowers or edible gold leaf.

Legal information and confidentiality

Mail order and Internet sales require certain personal information from clients in order to process and deliver orders, and to perform billing.
Failure to provide such information will invalidate the order.
Japonika Kitchen shall not share, for free or for payment, its clients’ information or addresses with third parties.

Governing law

The client and Japonika Kitchen agree that this agreement and their entire relationship shall be governed by the laws of Japan.
